Diddy isn’t backing down.
With just weeks left before his October 3 sentencing, the embattled hip-hop mogul is firing back at federal prosecutors who are pushing to uphold his Mann Act conviction.
In new court filings obtained by TMZ, Diddy’s legal team argues that prosecutors misapplied the century-old law, accusing them of using the wrong definition of prostitution to secure a guilty verdict.
The 55-year-old star—acquitted of racketeering and sex trafficking earlier this summer—was found guilty on two Mann Act charges related to transporting people for “prostitution.” But Diddy says the conviction doesn’t hold up under the law’s original intent.
“They Used the Wrong Definition”
Diddy’s lawyers point to the Mann Act’s origins in 1910, when it was also known as the White Slave Traffic Act.
According to the defense, the meaning of “prostitution” at that time was far broader—referring to a woman having sex outside of marriage.
But prosecutors, Diddy argues, used the modern definition—sex in exchange for money—to build their case.
“Prostitution in 1910 and prostitution in 2025 are not the same thing,” Diddy’s filing states. “The court must apply the meaning from the time the statute was passed.”

Paid Escorts or Paid for Time?
Diddy also insists that the government failed to prove he actually paid male escorts to sleep with his girlfriends.
Instead, his team claims the men were simply compensated for their time—not sex—and that Diddy himself was merely a voyeur, something he argues is not illegal.
The defense is asking Judge Arun Subramanian to toss the conviction entirely or, at minimum, grant a new trial.
What’s at Stake
The stakes couldn’t be higher.
Diddy was acquitted on the most serious charges of racketeering and sex trafficking in July, but the Mann Act conviction still carries serious penalties.
If the judge denies his request, the hip-hop legend faces sentencing on October 3, a moment that could redefine the next chapter of his already scandal-ridden career.
A Legal Back-and-Forth
This latest filing is part of a heated back-and-forth between the defense and the prosecution:
- July 2: Jury finds Diddy guilty only on Mann Act charges.
- Mid-July: Diddy files a motion requesting acquittal or retrial.
- August: Prosecutors oppose the motion, urging the court to uphold the conviction.
- Now: Diddy fires back, doubling down on his arguments.
The court has yet to issue a ruling, but with sentencing only weeks away, a decision is expected soon.
The Bigger Picture
The Mann Act has been controversial for over a century, with critics saying its outdated language makes it ripe for abuse.
Diddy’s case is now putting that argument back in the spotlight, raising questions about whether a 1910 law should decide a 2025 celebrity scandal.
The Bottom Line
For Diddy, this isn’t just about overturning two convictions—it’s about salvaging his legacy.
With prosecutors standing firm and the clock ticking toward October 3, the battle over how to define “prostitution” could end up deciding his fate.
