The woman who previously accused JAY-Z of sexual assault is now seeking to have his defamation lawsuit against her dismissed, arguing that her public statements are protected under legal immunity. The controversy began after she initially filed allegations against both JAY-Z and Sean “Diddy” Combs, but later withdrew her claims, citing doubts about their validity.
JAY-Z, whose real name is Shawn Carter, responded by filing a defamation suit, alleging that the public accusations inflicted irreparable damage to his reputation and professional standing.
Accuser Says Statements Were Based on Legal Filings
In her new motion to dismiss, the woman argues that her statements—particularly during an NBC interview—were drawn directly from official legal documents and should therefore be protected under litigation privilege. She claims the court should recognize that her public remarks are shielded from defamation claims due to their foundation in formal court proceedings.
As of now, JAY-Z’s legal team, led by attorney Alex Spiro, has not issued an official response to the motion.
Conflicting Claims: Mutual Agreement or Fabrication?
The legal standoff has intensified due to conflicting narratives about an alleged agreement to drop the case. In a previous filing, attorney Tony Buzbee, representing the woman, claimed that a settlement agreement was reached on February 4, 2025. He asserted that the parties agreed to withdraw ongoing litigation in the Southern District of New York (SDNY) in exchange for ceasing public and legal hostilities.
“The pressure exerted by Mr. Carter and his associates on Doe became overwhelming,” the motion stated. “An agreement was arrived at… involving the cessation of the litigation and the dismissal of the SDNY Action.”
However, Spiro dismissed Buzbee’s version of events as a “total lie,” asserting that no such agreement ever existed. He maintained that the woman’s initial lawsuit lacked merit from the beginning and that the defense is using false settlement claims to undermine JAY-Z’s right to seek justice.
Allegations of Intimidation and Breach of Agreement
In a rebuttal, Buzbee’s legal team accused JAY-Z’s attorneys of violating the terms of the alleged agreement shortly after it was made. They claim that individuals linked to JAY-Z’s camp allegedly sent investigators to intimidate the woman and her family.
“Despite her insistence on the truth of her initial claims, she agreed to withdraw the case,” Buzbee’s lawyer stated. “But that agreement was violated when Carter’s associates launched efforts to scare her into silence.”
