    In a critical development surrounding the tragic deaths of Johnny and Matthew Gaudreau, prosecutors in the case are seeking to exclude the brothers’ blood alcohol content (BAC) levels from the upcoming trial of Sean Higgins, the man accused of causing their deaths. The request, filed by the Salem County Prosecutor’s Office in New Jersey on Wednesday, argues that the Gaudreau brothers’ intoxication levels are irrelevant to the charges against Higgins and should not be presented as evidence to the jury.

    This motion was filed as part of the ongoing case involving the collision that led to the deaths of NHL star Johnny Gaudreau, aged 31, and his brother Matthew, aged 29, on August 29, 2024. Both brothers were biking on a New Jersey roadway when they were struck by Higgins, who has since been charged with multiple serious offenses, including vehicular homicide and aggravated manslaughter.

    The Prosecutor’s Argument

    The prosecution’s motion centers around the assertion that the BAC levels of the victims have no bearing on the central issue of the case: the defendant’s actions. According to court documents obtained by TMZ Sports, the prosecutors claim that the toxicology reports showing the Gaudreau brothers’ intoxication levels should not be used as a defense strategy in the trial.

    “Multiple witness accounts show that it was the defendant’s actions and his actions alone that caused the collision that led to Matthew and John Gaudreau’s deaths,” the prosecution stated. The prosecutors also noted that the brothers’ intoxication and the way they were riding their bicycles on that fateful day are not relevant to the charges against Higgins.

    Higgins’ defense team, however, has made the argument that the Gaudreau brothers were intoxicated at the time of the incident, with Johnny Gaudreau’s BAC reported at 0.129 and Matthew Gaudreau’s at 0.134. These levels are above the legal limit for driving in New Jersey, though it’s important to note that the brothers were not behind the wheel of a vehicle at the time of the crash. For comparison, Higgins’ BAC was measured at 0.087, which is lower but still above the legal driving limit in the state.

    Although the defense has yet to explicitly argue how these toxicology reports relate to the case, they may be attempting to use the brothers’ intoxication to lessen the perception of responsibility on the part of Higgins, suggesting that their impaired judgment may have contributed to the tragedy.
