    JAY-Z Pushes for Dismissal of Allegations, Argues Lawsuit Does Not Meet Legal Criteria

    Reports reveal that JAY-Z has once again moved to have the lawsuit accusing him of sexually assaulting a 13-year-old girl dismissed, this time on procedural grounds. Last week, the music mogul requested that the case be thrown out and also pushed for his accuser’s name to be made public—both of which were rejected by the court.

    In his latest legal filing, JAY-Z’s attorney, Alex Spiro, has submitted a motion to dismiss the lawsuit, focusing on procedural arguments centered on the timing of the alleged incident. Spiro asserts that the lawsuit does not meet the criteria established by the New York City’s Violence Protection Act (GMVA), as the alleged assault occurred after the law had been implemented.

    Legal Arguments Against the Lawsuit:
    The motion to dismiss emphasizes that the alleged assault occurred in September 2000, whereas the GMVA law was enacted on December 19, 2000. Spiro contends that the law cannot apply retroactively, and therefore, the case is not valid under the GMVA statute. According to the motion, “Plaintiff asserts a violation of the GMV Law for conduct that purportedly occurred in September 2000. But the GMV Law was not enacted until December 19, 2000, three months after the FAC claims the conduct occurred, and cannot apply retroactively to create a cause of action unavailable to Plaintiff at the time in question.”

    Moreover, Spiro argues that the lawsuit lacks merit because the GMVA statute applies only within New York City’s jurisdiction. He contends that the alleged assault, which took place at a private residence, falls outside the city’s legal boundaries.

    The Allegations and JAY-Z’s Response:
    The lawsuit stems from allegations made by an unnamed woman who claims she was sexually assaulted at an afterparty hosted by Diddy in 2000, following the MTV Music Awards. The woman alleges that both Diddy and JAY-Z raped her in a bedroom after she was drugged at a property located about 20 minutes from Radio City Music Hall, the venue for that night’s event.

    JAY-Z has consistently denied the allegations, calling them “heinous” and “idiotic.” In a public statement, the rapper and business mogul condemned the claims, defending his integrity and criticizing the accuser’s lawyer, Tony Buzbee, who is also involved in a separate legal matter. JAY-Z said, “You have made a terrible error in judgment thinking that all ‘celebrities’ are the same. I’m not from your moral world. I’m a young man who made it out of the project of Brooklyn. We don’t play these types of games. We have very strict codes and honor.” He further stated, “We protect children, you seem to exploit people for personal gain.”

    Rebuttal and Evidence:
    Earlier this month, Alex Spiro addressed the media at Roc Nation’s headquarters, presenting a detailed rebuttal to the accusations. During his address, Spiro showed images of JAY-Z at an event that was different from the one cited by the accuser. He also pointed out that none of Diddy’s properties during the time in question matched the descriptions provided in the lawsuit.

    As the legal battle continues, JAY-Z’s legal team remains steadfast in their defense, asserting that the claims lack legal merit and do not meet the necessary criteria for a lawsuit. With JAY-Z strongly denying the allegations, the case is expected to draw significant attention in the coming weeks as it moves through the courts.
