Will Smith Could Be Deposed in Jada Pinkett Smith Legal Battle

Court filings show Bilaal Salaam is seeking to question Will Smith as part of his ongoing lawsuit against Jada Pinkett Smith, but her legal team argues the actor is not a party to the case.

Will Smith may soon find himself pulled into an ongoing legal dispute involving his wife, Jada Pinkett Smith, after a former friend requested to question the Oscar-winning actor under oath.

According to court documents obtained by TMZ, Bilaal Salaam is seeking to depose Will as part of his $3 million lawsuit against Jada. While the request has added a new twist to the case, Jada’s attorneys argue there is no basis for the deposition because Will is not a party to the litigation.

The latest filing marks another development in a lawsuit that has already produced several legal rulings while continuing to move through the courts.

Bilaal Salaam Wants to Depose Will Smith

According to the court filings, Bilaal emailed Jada’s attorney on July 7, requesting permission to depose Will Smith as part of the discovery process.

The request was met with a firm response from Jada’s legal team.

In an email included with the court filing, Jada’s attorney wrote, “As for your proposed deposition of Will Smith, there is nothing to meet and confer about.”

Her legal team further argued that Will is not involved as a party in the lawsuit and noted that he had not been served with a subpoena requesting his testimony.

At this stage, the filing reflects Bilaal’s request and Jada’s opposition. The court has not indicated whether Will will ultimately be required to testify.

    Jada Seeks Additional Evidence

The correspondence was attached to a motion filed by Jada Pinkett Smith as part of the ongoing litigation.

According to the filing, Jada is asking the court to compel Bilaal to produce additional evidence, including medical records related to his claims of emotional distress.

The motion argues that despite seeking damages in the lawsuit, Bilaal has not produced documentation supporting those allegations.

Whether the court grants Jada’s request remains to be decided.

    How the Lawsuit Began

The legal dispute stems from allegations previously made by Bilaal Salaam.

As previously reported, he alleges that people associated with Jada threatened him after he declined to help manage public relations fallout following Will Smith’s widely discussed Oscars incident.

Bilaal also claims tensions escalated after Jada learned he was writing a memoir that included references to the Smith family.

He is seeking $3 million in damages.

Jada has denied the allegations and disputes the claims made against her.

According to previous court proceedings referenced in the filing, the court dismissed some of Bilaal’s claims and ordered him to pay more than $30,000 toward Jada’s legal fees.

However, other parts of the lawsuit remain active.

Why Will Smith’s Potential Testimony Matters

Although Will Smith is not currently named as a defendant in the lawsuit, Bilaal appears to believe the actor could provide testimony relevant to the case.

Jada’s legal team disagrees, maintaining that Will has no legal obligation to participate because he is not a party to the litigation and has not been subpoenaed.

Whether Bilaal formally seeks a subpoena—or whether a judge would approve one—remains unclear based on the current court filings.

For now, Will has not publicly commented on the request.

A Case That Continues to Evolve

The latest filing adds another layer to a lawsuit that has already seen several procedural developments.

While some of Bilaal’s original claims have been dismissed, the remaining portions of the case continue through the legal process, with both sides disputing evidence and discovery obligations.

The request to depose Will Smith highlights how the litigation could potentially expand beyond the current parties if the court determines additional testimony is warranted.

At this point, however, no ruling has been announced on the deposition request.

The Smith family has faced years of intense public scrutiny, with personal and professional matters frequently becoming headline news. This latest legal filing underscores how disputes involving public figures can continue to evolve long after the initial controversy fades from the spotlight.

While Bilaal Salaam seeks to bring Will Smith into the discovery process, Jada’s legal team maintains that the actor should remain outside the case. Whether the court agrees could shape the next phase of the litigation.

For now, the legal battle continues—and whether Will Smith will ultimately be questioned under oath remains a matter for the court to decide.
