Kai Cenat isn’t just fighting a lawsuit — he’s flipping the blame.
The streamer claims the man suing him over an alleged attack by his bodyguard was actually the person who started the confrontation, TMZ has learned.
TMZ obtained court documents filed by Kai in response to a lawsuit brought by Dustin Batista, who claims Kai’s security guard, Lamont Gilbert — aka Cuddy — assaulted him during the 2025 Dominican Day Parade in New York City.
Kai denies wrongdoing and is laying out the defenses he plans to raise in court.
According to the documents, Kai claims Dustin was the “initial aggressor.” He further alleges Dustin “initiated, provoked, caused and/or escalated the physical confrontation.”
That’s a very different version of events from the one presented in Dustin’s lawsuit.
Dustin previously alleged that Cuddy struck and punched him during the parade. He claimed the attack was unprovoked and insisted he did not threaten or do anything to trigger the confrontation.
Dustin is seeking unspecified damages for alleged assault and battery and is attempting to hold Kai responsible for his security guard’s alleged actions.
Now Kai is essentially saying: Not so fast.
His court filing doesn’t establish what actually happened during the confrontation. Instead, it lays out his position in the legal fight and the arguments he intends to use to defend himself.
And this isn’t the only legal headache involving Kai and alleged festival confrontations.
As TMZ previously reported, the streamer is also facing another lawsuit from a different man over an alleged incident at another festival.
For now, the competing accounts put the focus squarely on what happened during that Dominican Day Parade confrontation — and whether Dustin or Kai’s security team was responsible for escalating it.
That question will ultimately have to be sorted out through the legal process.
