Diddy Demands Bail: Says He’s Locked Up for “Being a Swinger”

In the newly filed court docs obtained by TMZ, Diddy’s defense team paints a very different picture of the scandalous accusations that have rocked the entertainment world.
They argue that Diddy was not exploiting women, but simply engaging in a consensual swinger lifestyle with his longtime girlfriends — including Cassie and a woman identified in court only as “Jane.”
“He hired professional male escorts — none of them were minors — to have sex with his girlfriend,” the motion reads. “This is not trafficking. This is a consensual adult relationship.”
The attorneys emphasized that Diddy never personally engaged in sex with the male escorts. They say the media and prosecution twisted the narrative to make it look like something far more sinister than it was.
The Mann Act — A Law From Another Era?
Diddy’s legal team didn’t stop there. They called out the Mann Act itself, claiming it’s a relic of a bygone era.
“This law was passed 115 years ago, in June 1910,” they note, arguing that today’s society has dramatically evolved in how it views adult sexual behavior, especially involving open relationships, kinks, and consensual non-monogamy.
They believe the charges weaponized old-fashioned views about sexuality and morality to criminalize behavior that is widely accepted today in private adult relationships.
Why Diddy Was Denied Bail in the First Place
Back in July, just hours after the guilty verdict was read, Judge Arun Subramanian denied Diddy’s initial bail request — declaring him a “danger to the community.”
The judge cited Diddy’s past violent behavior, including high-profile incidents involving Cassie, whose 2016 hotel beating video was played in full for the jury, and a more recent altercation with “Jane” in June 2024.
While his lawyers didn’t shy away from the facts, they tried to minimize the scope.
“Diddy has not been violent since 2018, aside from the isolated incident in June with Jane,” the defense argues in the latest motion.
New Bail Offer: $50 Million, House Arrest, and Full Surveillance
In a dramatic new proposal, Diddy is now offering a massive $50 million bond, secured by his Florida estate and co-signed by three wealthy individuals deemed “financially responsible.”
But that’s not all.
If granted bail, Diddy says he’s willing to:
- Stay confined to his Miami mansion
- Surrender his passport
- Limit his travel to the Southern District of Florida and Southern District of New York
- Submit to electronic monitoring
- Agree to home detention
- Enter mental health and substance abuse treatment
- Allow 24/7 private security
- Report regularly to the U.S. Pretrial Services Agency
“If the court wants to add additional conditions, we won’t object,” the defense team wrote.
This latest move shows just how desperate Diddy is to avoid spending another day behind bars as he awaits judgment.
