L.A. D.A. Opposes Menendez Brothers’ Request for New Trial Based on Sexual Abuse Evidence
The Menendez Brothers, Erik and Lyle, have been dealt a blow in their attempt to secure a new trial after new evidence surfaced. L.A. County District Attorney Nathan Hochman recently announced his office will oppose the brothers’ request for a retrial, dismissing the new evidence as irrelevant to their conviction for the 1989 murders of their parents.

The new evidence presented by the defense includes a letter from Erik to his cousin, allegedly written in 1988, where Erik discusses claims of sexual abuse. Additionally, a member of the boy band Menudo came forward with allegations that Erik and Lyle’s father, Jose Menendez, molested him in the 1980s. However, D.A. Hochman stated that these claims would not have changed the outcome of the brothers’ conviction.
Hochman expressed skepticism about the authenticity of the 1988 letter and questioned the credibility of the abuse allegations. He emphasized that the key issue in the case remains the brutal murders committed by the brothers, not the alleged sexual abuse.

The District Attorney argued that the brothers’ actions, including their attempt to cover up the murders and Lyle’s execution-style kill shot to their mother, were not mitigated by any claims of abuse. Hochman reiterated that the murder itself is the central focus of the case.

While Hochman opposed the new trial, he was non-committal regarding the issue of resentencing. If a judge decides to resentence Erik and Lyle to a term shorter than life in prison, the brothers could become eligible for release through a parole board. The possibility of their release has garnered support from several people, including 20 family members, who have called for their freedom.
