Andrew Tate Won’t Be Charged in Bri Stern Assault Case—DA Cites Lack of Evidence

Controversial internet figure Andrew Tate is off the hook—at least in Los Angeles. The L.A. District Attorney’s Office has officially declined to file charges against Tate in connection to a March police report filed by Bri Stern, who accused him of abusive behavior during a sexual encounter.

According to the DA’s office, the case was dropped due to insufficient evidence, bringing temporary relief to the embattled influencer who remains under legal fire in other jurisdictions.

Bri Stern Accused Tate of Choking Her During Sex

In the police report filed earlier this year, Bri Stern alleged that Tate choked her multiple times during a sexual encounter, even after she explicitly told him to stop.

Stern, a model and content creator, shared disturbing claims about their interaction, stating she felt violated and unsafe during what began as a consensual situation.

Tate and his legal team denied all wrongdoing—and now, prosecutors say they don’t have enough evidence to move forward with charges.

Defense Attorney: “The Evidence Showed His Innocence”

Tate’s attorney Joseph McBride tells TMZ his client cooperated fully with the investigation, even submitting a “do-not-prosecute” packet outlining reasons why the charges should not be pursued.

“Andrew made himself fully available, submitted to questions, and provided documentation to support his side,” said McBride.

He also added that the DA’s decision validates their claim that Tate was wrongfully accused, calling the case part of a “global weaponization of the courts” by Tate’s adversaries.

“Tate’s foes have weaponized courts globally to attack him,” McBride continued. “We’re grateful the evidence clearly showed his innocence, sparing him an unjust indictment.”

Alleged Texts Paint a Troubling Picture—But Weren’t Enough

While no criminal charges will be filed, the case remains clouded in controversy—especially after TMZ previously obtained alleged text messages exchanged between Tate and Stern.

In the texts, Tate appears to speak about violence in a sexual context, including discussions that suggested non-consensual acts. While the messages were unsettling to many, prosecutors ultimately determined they did not meet the threshold for criminal prosecution.

These alleged texts were not released in full and may have lacked the legal weight required to prove intent or criminal misconduct beyond a reasonable doubt.

Bri Stern Still Pursuing a Civil Lawsuit

Though criminal charges are off the table (for now), this isn’t the end of the legal battle.

Bri Stern has filed a civil lawsuit against Andrew Tate, seeking damages for the alleged assault and emotional distress she claims to have suffered.

Sources close to Bri say she was not informed of the DA’s decision prior to the media report. One source told TPR, “Bri feels blindsided and unheard. This is far from over.”

Her team has yet to publicly comment on the dismissal, but legal insiders suggest the civil case could proceed regardless of the lack of criminal charges.

Tate Still Facing Serious Charges Abroad

While this may be a small legal victory for Tate, it pales in comparison to the legal storm brewing in Romania, where he and his brother Tristan Tate are still under investigation for sex trafficking, rape, and organized crime.

The brothers have repeatedly denied the allegations, calling them part of a “coordinated international smear campaign.”

Romanian prosecutors have seized property, bank accounts, and vehicles as part of their investigation, which has been ongoing since late 2022.

Despite their release from house arrest, formal charges are expected to be filed later this year.

Who Is Bri Stern?

Bri Stern is a rising digital influencer and model with a growing following on Instagram and TikTok. After filing the police report against Tate, she also took to social media to share her side of the story, stating:

“I didn’t deserve this. I spoke up because staying silent is part of the problem.”

Her emotional video on Instagram, posted back in April, went viral, garnering millions of views and sparking debate over consent, power dynamics, and the credibility of online influencers.

Despite critics questioning her motives, many praised her bravery for coming forward.

Tate’s Polarizing Public Image

Love him or loathe him, Andrew Tate continues to dominate headlines. The former kickboxer-turned-podcaster rose to notoriety through a mix of hyper-masculine rhetoric, online self-help courses, and viral controversies.

But his brand of masculinity has come under heavy fire:

  • Critics say Tate promotes misogyny, coercion, and emotional abuse
  • Supporters argue he represents freedom of speech, male empowerment, and anti-establishment thinking

This latest legal update is likely to intensify both camps, as some will see it as vindication—while others will view it as yet another example of a broken justice system.

What’s Next for Andrew Tate?

With the Los Angeles case closed, Tate’s legal team is now focused on clearing his name in Romania and dealing with similar claims in other regions. According to McBride, they plan to replicate their “do-not-prosecute” strategy wherever possible.

“We will respond to all false allegations with transparency and force,” said the attorney.

However, the civil suit from Bri Stern remains a looming threat, and legal experts warn that even unfiled criminal charges can have lasting damage on a public figure’s reputation and brand partnerships.

💬 What Do You Think? Did the DA Get It Right?

Was the dismissal of charges fair based on evidence—or is this another case of celebrity privilege in action? And what impact will this have on the other serious allegations facing Andrew Tate?
