Sean “Diddy” Combs is making one last stand in court — and his high-powered legal team is pulling no punches as they fight to get his Mann Act convictions tossed out ahead of sentencing.
The embattled music mogul arrived at a New York City courthouse Thursday, flanked by family, attorneys, and a wave of cameras, as his lawyers tried to convince the judge that the government got it wrong.
Diddy’s Defense: “Prostitution Doesn’t Apply Here”
Leading the charge was attorney Marc Agnifilo, who argued that the Mann Act — a century-old law originally designed to crack down on sex trafficking — doesn’t apply to Diddy’s alleged actions.
According to his team:
- Prostitution means one person paying another for sex.
- Diddy, they insist, never paid for sex himself.
- Instead, they claim he only watched encounters arranged by ex-girlfriends and associates.
The defense doubled down by framing Diddy’s behavior as amateur pornography, noting many of the encounters were filmed. They argued that filming sexual activity isn’t a crime, and certainly shouldn’t be twisted into a Mann Act violation.
Prosecutors Clap Back
Prosecutors weren’t having it. They countered with a sharp rebuttal:
- Diddy didn’t just sit back as a passive observer — he reimbursed his exes for arranging the encounters.
- He also derived sexual gratification from watching, which they argue makes him an active participant.
- And because not every encounter was filmed, prosecutors dismissed the defense’s “pornography” argument as a distraction.
They also stressed this is not a free speech case about adult content but about facilitating prostitution, plain and simple.
Diddy’s Team Targets the Mann Act
In a bold move, Diddy’s lawyers attacked the law itself, calling the Mann Act an outdated, racially biased statute.
They pointed out that judges have criticized it for more than a century, and argued it has no place in 2025 legal proceedings — especially in a case involving consensual adult behavior.

Before arguments began, Diddy’s family — including his mother and several of his children — arrived at the courthouse to show support.
Their presence was a powerful reminder of what’s at stake: Diddy’s freedom, reputation, and legacy.
As court wrapped, no decision was issued. The judge said he would rule soon, leaving Diddy and his camp anxiously waiting.
