R. Kelly Files Clemency Petition Seeking Commutation of His 31-Year Prison Sentence
R. Kelly is making a formal bid for early release from federal prison.
According to his attorney, Beau Brindley, the imprisoned R&B singer has filed a clemency petition with the U.S. Department of Justice’s Office of the Pardon Attorney, asking President Donald Trump to commute his combined 31-year federal prison sentence.
The petition, which Brindley told TMZ was submitted on Tuesday, represents Kelly’s latest effort to reduce his prison time after multiple federal convictions in New York and Illinois.
Attorney Says Clemency Petition Was Months in the Making
Brindley told TMZ that he and Kelly had been working on the clemency request for an extended period before officially filing it.
According to the attorney, the petition asks President Trump to commute—not overturn—Kelly’s federal sentence.
Brindley also said he plans to continue pursuing what he described as “every other avenue for justice” on behalf of his client in addition to the clemency request.
As of publication, there has been no public indication that the White House or the Department of Justice has acted on the petition.

Kelly Is Serving a Combined 31-Year Federal Sentence
Kelly is currently serving prison sentences stemming from two separate federal criminal cases.
In 2021, a federal jury in Brooklyn, New York, found him guilty of multiple offenses, including racketeering, sexual exploitation of children, forced labor, and violations of the Mann Act.
The following year, in Chicago, a separate federal jury convicted him of producing child pornography and enticing a minor to engage in sexual activity.
Those convictions resulted in a combined prison sentence totaling 31 years.
The convictions remain in effect.
Defense Challenges Racketeering Charge
In explaining the basis for the clemency request, Brindley argued that prosecutors improperly relied on federal racketeering laws in Kelly’s New York case.
According to the attorney, he believes the racketeering charge represented an abuse of prosecutorial authority and that Kelly was unfairly targeted because of his public profile.
Those arguments reflect the defense’s position and do not alter the jury’s verdicts or the federal court judgments.

Health Concerns Also Cited
Brindley also told TMZ that Kelly’s medical condition is another reason he believes clemency should be granted.
The attorney said Kelly has a blood clot in his neck and is experiencing other significant health problems.
The reported health concerns have not been independently verified in the information provided, and no recent medical records were included with TMZ’s report.
No Indication of White House Discussions
While Kelly’s legal team has formally submitted the clemency petition to the Department of Justice, Brindley declined to say whether he has spoken directly with President Trump or officials at the White House about the request.
Under the federal clemency process, petitions are typically reviewed by the Office of the Pardon Attorney before recommendations are made. Ultimately, the decision to grant or deny clemency rests with the president.
There is no indication that any decision has been made regarding Kelly’s request.

Why the Petition Matters
Presidential clemency remains one of the few remaining legal avenues available to federal inmates seeking relief after conviction and sentencing.
For Kelly, the filing does not reopen his criminal cases or overturn the jury’s findings. Instead, it asks the president to reduce the amount of time he must serve.
Whether the request receives further consideration remains unclear.
What’s Next?
For now, Kelly’s petition is before the Department of Justice as his legal team continues exploring additional legal options.
Until any action is taken, his convictions and sentence remain unchanged, leaving the clemency request as the latest chapter in his ongoing legal battle.
