Kim Zolciak’s 15-year-old son, KJ Biermann, is pushing back against all seven felony charges in his sexual assault case, with his legal team arguing that prosecutors have not provided sufficient details to support key allegations.
According to court documents obtained by Page Six, KJ’s attorney, Jason Sheffield, is challenging how prosecutors have described the alleged use of force, physical injuries and restraint at the centre of the case.
Sheffield argues that the aggravated child molestation charge does not clearly identify the physical injury prosecutors claim was caused.
The defence also questions the aggravated sexual battery and sodomy charges, arguing that the prosecution has not adequately explained how force was allegedly used.
His attorneys are additionally challenging three sexual battery counts, describing them as virtually identical. They also argue that the false imprisonment charge fails to explain how KJ allegedly restrained the person who accused him.
The defence is requesting a hearing and wants the lead detective to testify as the legal battle continues. KJ has maintained his innocence.
The case dates back to April, when a female classmate accused him of sexually assaulting her inside a gym changing room in Georgia. According to the allegations, he forced her to perform oral sex and digitally penetrated her despite her objections.
KJ was arrested in August and subsequently indicted on seven felony charges. He pleaded not guilty to all seven counts in October.
The case has also involved separate allegations concerning videos investigators reportedly found on KJ’s phone. Prosecutors previously claimed the recordings showed him engaging in sexual acts with an underage relative.
However, Sheffield disputed that characterization, describing the earlier incident as inappropriate behaviour between middle schoolers.
KJ spent approximately a month in custody before being released on bond. Under his current release conditions, he is confined to his mother’s home while the proceedings continue.
The latest defence filing represents another development in a case that has drawn significant attention because of the teenager’s family background and the serious nature of the allegations.
